Directorate Industrial Safety & Health

Annual Development Programme for 2011-2012 of Directorate Industrial Safety & Health (DISH) provides plan outlay of Rs.2022.00 lac. Director Industrial Safety & Health is enforcing the following labour laws which provide for the purposes mentioned, for the workers in factories and construction sites-

The Factories Act, 1948 & Gujarat Factories Rules, 1963.

Provisions for safety, health, welfare, working hours & leave with wages for the workers working in the factories are being looked after by the department through implementation of the Factories Act, 1948 & Rules made there under.

The Payment of Wages Act, 1936 & Rules made there under.
The payment of wages, without any type of illegal deduction to the factory workers are required to be paid in specified time.
The Maternity Benefit Act, 1961 & Rules made there under.
Maternity benefits are being given to women workers by implementing the provisions of the Maternity Benefit Act, 1961 and Rules made there under.
The Gujarat Physically Handicapped Persons (Employment in Factories) Act, 1982 & Rules made there under.

The provisions of the Gujarat Physically Handicapped Persons (Employment in Factories) Act, 1982 & rules made there under are being implemented by this department and thereby handicapped persons equal to 1% of the strength of the factory workers are employed in the factories. Previously the Act was applicable to factories employing 200 or more workers. From 07/05/2004 the applicability is reduced to 100 or more workers. As on 30/10/2008, 4017 physically handicapped persons are employed in different factories.

The Building & Other Construction Workers’ (Regulation of Employment and Conditions of Service) Act, 1996 & Rules made there under

Safety, health, welfare, working hours etc. of the workers, working in building and other construction works are looked after by this department by implementing the provisions of the Building and Other Construction Workers’ (Regulation of Employment and Conditions of Service) Act, 1996 and Rules made there under.

Chemical Accident (Emergency Planning, Preparedness & Response) Rules, 1996 and Manufacture, Storage and Import of Hazardous Chemicals Rules, 1989.

Gujarat has about 4600 hazardous chemical factories. Out of which 530 are Major Accident Hazard (MAH) factories. Compared to other states, Gujarat has the highest number of MAH factories, comprising 1/3rd of total National MAH factories. For the protection of workers working in hazardous chemical factories, people living in the vicinity of such factories and environment, the provisions of the Chemical Accident (EPPR) Rules, 1996 and Manufacturing, Storage and Import of Hazardous Chemical Rules, 1989 under the Environment (Protection) Act, 1986 are strictly implemented by this department.

Proposed Outlay for Annual Development Plan
An outlay of Rs.2022.00 lac is proposed for Annual Development Plan for the year 2011-2012 as under:
