Release and Rescue of child labourers

Release and rescue of child labour identified is the second important intervention where labour, factories and police departments have to play key roles. Release and rescue operations have started in Gujarat through the Task Force. The Task Force has organized raids on factories and establishments employing child labour and thousands of children are rescued and sent back to their families through Juvenile Aid Police Unit. Release and rescue operations should result in familial rehabilitation wherever possible and educational rehabilitation of all children. Such Task Force has been established in all districts by G. R. No. ECA-2006/2455(4-M.3)26 dated19/10/2006 is already issued by the Government. The major actions taken will be as follows
.Formation of Task Force in each district as per G. R. No. ECA-2006/2455(4-M.3), dated 19/10/2006,
.Organizing regular raids by Task Force,
.Taking physical possession of children by the Police with proper precautions. The precautions for the children to be taken at the time of rescue operations can be covered in training of task force members,
.Preparing the profile of the children rescued by the Labour Officer. (Format for the profile will be prepared by Labour Department and State Resource Centre together),
.Determining exact age of the child by concerned medical authority immediately after the raids, continuing practice of presenting children to Child Welfare Committee, constituted under Juvenile Justice (Care and Protection of Children) Act, 2000,
.Sending the children to their respective families, those belong to another State through Special Police Unit train for the purpose under JJ Act. The Government is also providing special allowance for transportation and food in such case,
.Rehabilitation of the children from other districts in any available Children or shelter home, declared by Government under JJ Act,
.Ensuring that children are placed in an atmosphere conductive for their physical, social, mental and emotional development in children or shelter homes, providing training to functionaries of children or shelter homes for the same,
.Provision of all the care (Food, medical aid, clothes, etc.) to children until they are sent back to their families or admitted in hostels by the labour department, provision of special allowance for transport and food in that case,
.Filing FIR against employer in the Police Station,
.Filing the case against the employer of child labour by the Labour Department under relevant law,
.Appointment of a special Public Prosecutor to prosecute the case,
.Training of Task Force Members,
.Decision should be taken to ban child labour in all forms, and
.Conduct seminar and workshop to discuss the possibility to ban all forms of child labour.
