Statutory provisions to eliminate child labour

Name of the Act Prohibition of child labour Penalties
The Bombay Shop and Establishments Act, 1948
No child below the age of 14 years shall be required or allowed to work whether as employee or otherwise in any shop and establishment. [S. 32]
Employer and manager shall be punished with Rs. 25 to Rs.250.
The Juvenile Justice (Care and Protection of Children) Act, 2000
The Act makes it an offence if, any person ostensibly procures the child in needs of care and protection (below the age of 18 years) for the purpose of any hazardous employment keeps him in bondage and withholds his earnings or uses such earning for his own purposes
He shall be punished with imprisonment up to three years and fine. [section 26]
According to section of Child labour (P&R) Act, the provisions of Child Labour (P&R) Act shall be in addition to, and not in derogation of the provisions of other enactments, namely – (i) The Factories Act, 1948, (ii) The Mines Act, 1952, (iii) The Motor Transport Workers Act, 1961, and (iv) The Merchant Shipping Act, 1958.
