Penalties under this Act

.Penalties
According to section 14 of the Act, whoever employs any child or permits any child to work in prohibited occupation or process, shall be punishable with imprisonment for 3 months to one year or fine of Rs. 10,000 to Rs. 20,000 or with both.
.Penalties for subsequent offence
Whoever, having been convicted of an offence of employs of, or permits any child to work in prohibited occupation or process, commits a like offence afterwards, he shall be punishable with imprisonment for a term which shall not be less than six months but which may extend to 2 years. These provisions of penalties shall also apply to the contravention of (a) section 67 of the Factories Act, 1948, (b) section 40 of the Mines Act, 1952; (c) section 109 of the Merchant Shipping Act, 1958; and (d) section 21 of the Motor Transport Workers Act, 1961.
.Penalties for failure in notice and maintain register etc.
Whoever fails to (a) give notice; (b) maintain a register or makes any false entry in any such register; (c) display a notice containing; or (d) comply with or contravenes any other provisions of this Act or the rules made thereunder, shall be punishable with simple imprisonment up to one month or with fine up to Rs. 10,000 or with both.

Again, the SC has directed the employers of children below 14 years must comply with the provisions of the Child Labour (Prohibition and Regulation) Act providing for compensation, employment of their parents / guardians and their education.16
