The Sales Promotion Emplyees(Conditions of Service) Act,1976

.Salient Features of the Act
ObjectThis Act to regulate certain conditions of service sales promotion employees in pharmaceutical industry.
Applicability
It extends to the whole of India to every establishment engaged in Pharmaceutical Industry. The employees working in any establishment for hire or reward to do any work relating to promotion of sales or business or both. But the employees who are in supervisory capacity drawing wages more than Rs. 1,000/- per month and those engaged mainly in a managerial or administrative capacity are not covered under the Act. There is a provision for holidays of various types in the Act. The following Acts are also applicable to sales promotion employees:

1) The Workmen's Compensation Act, 1923;
2) The Industrial Disputes Act, 1947;
3) The Minimum Wages Act, 1948;
4) The Maternity Benefit Act, 1965;
5) The Payment of Gratuity Act, 1972;
6) The Payment of Bonus Act, 1965.

Penalties are prescribed in the Act for violation

Registers to be maintained
(a) Letter of appointment in Form -A Rules 22-(I)
(b) Register of sales promotion employees in Form-B Rules 23 -A
(c) Service book in Form-C Rules - 23 (B)
(d) Leave account of employees in Form-E
(e) Form - D Register of Service Books for sales promotion Employees rules -23(C)
