Contract Labor (Regulation and Abolition) Act, 1970 - Sec. 10 - Factories Act, 1948 - Secs. 2(n) and 46 - Notification by Karnataka Government dated April 11, 1997, prohibiting employment of contract labor in industrial canteens and factories employing 250 workers or above, in State of Karnataka, challenged in writ petitions, which were dismissed - Provision of canteen welfare measure - Requirement to run it, incidental to main activity of establishment hence workmen in canteen held were engaged directly as workers in factory - Petitions found to be without merit and therefore dismissed :

Contract Labor (Regulation and Abolition) Act, 1070-Section 10(1)-Industrial Disputes Act, 1947-Section 2(a)-Abolition of contract Labor-Issuing notification for -Appropriate Government in respect of an establishment-Whether State or Central Government-Determination of question depends upon the answer of question-Whether the industry is carried on by or under the authority of Central Government-To be ascertained on facts and circumstances of each case-After 28.11.1986, in view of new definition of the expression "Appropriate Government"-The answer to question has to be found in clause (a) of Section 2 of Industrial Disputes Act.
