Right of workers

Where the workers employed in any factory
engaged in a hazardous process have reasonable apprehension
that there is a likelihood of imminent danger to their lives
or health due to any accident, they may bring the same to
the notice of the occupier, agent, manager or any other person
who is incharge of the factory or the process concerned directly
or through their representatives in the Safety Committee and
simultaneously bring the same to the notice of the Inspector.

It shall be the duty of such occupier, agent,
manager or the person incharge of the factory or process to
take immediate remedial action if he is satisfied about the
existence of such imminent danger and send a report forthwith
of the action taken to the nearest Inspector.

If the occupier, agent, manager or the person
incharge referred to in sub-section (2) is not satisfied about
the existence of any imminent danger as apprehended by the
workers, he shall, nevertheless, refer the matter forthwith
to the nearest Inspector whose decision on the question of
the existence of such imminent danger shall be final.

To obtain from the occupier, information relating
to workers health and safety at work;
|
 |
To get trained within the factory wherever
possible, or, to get himself sponsored by the occupier for
getting trained at a training centre or institute, duly approved
by the Chief Inspector, where training is imparted for workers
health and safety at work;
|
 |
To represent to the Inspector directly or
through his representative in the matter of inadequate provision
for protection of his health or safety in the factory.

Worker will not interfere with or misuse any
appliance, convenience or other things provided to secure
the health, safety and welfare of workers
|
 |
Worker without reasonable cause will not do
anything which is likely to endanger anybody.
|
 |
Worker will not willfully neglect to make
use of any appliance or any thing provided to secure health
& safety of workers.
|
 |
Worker will Cooperate for undergoing required
medical checkup.
|
 |
If any worker employed in a factory contravenes
any of the provisions of this section or of any rule or order
made there under, he shall be punishable with imprisonment
for a term which may extend to three months, or with fine
which may extend to one hundred rupees, or with both.

Every worker employed in the processes covered
in the First Schedule of theAct and Appendix shall not make
any safety device or appliance or any guardingor fencing arrangement
inoperative or defective and shall report the defectivecondition
of the aforesaid arrangements as soon us he is aware of any
suchdefect.

Before commencing any work, all workers employed
in processes covered inthe First Schedule of the Act shall
check their work place as well as themachinery, equipment
or appliance used in the processes and report anymal-function
or defect immediately lo the supervisor or any responsible
personof the management.

All workers shall co-operate in all respects
with the management while c.irryinl;out any work or any emergency
duty assigned lo them in pursi.iance of thisschedule and shall
always use all the personal protective equipinents issued
lothem in a careful manner.

All workers employed in the processes covered
in the First Schedule ol the Acior appendix shall not smoke
in the process area or storage area. II specialfacilities
are provided by the management only such facilities shall
be used.

All workers employed in the processes covered
in the First Schedule ot the Aci shall not remain in unauthorised
place or carry out unauthorised work orimprovise any arrangements
or adopt short out method or misuse any of lhcfacilities provided
in pursuance of this Schedule, in such a manner as to causerisk
lo themselves as well as to others employed.

The workers shall not refuse undergoing medical
examination as required under
these rules.
