Activity of the Board
On the basis of scheme of 1981 and
Act of 1979 activities of the Board is mainly divided into two parts
mentioned as under:
(A) Legal activity
(B) Implementation of welfare
scheme.
(A) Legal Activity :
(1) As per Article 12 of
Scheme of 1981 registration of employer is compulsory in prescribed
application from which is annexed at Annexure-2
(2) As per Article 13 of the said scheme registration
of worker is done who is India citizen and within age of 60 years
for that prescribed application from is annexed at Annexure-3
Under Article 16(1) & 16(2) registration fee
for employer is Rs. 25/- and Rs. 1/- for employee subsequently.
Total number of employers registered under Article
12 is 4,723 while under Article 13 total number of employees registered
is 2,051 by the end of 12-10-2007.
Under Article-17 As per provision of registered employees
identity cards are given to 150 employees by the end of 31-12-2001.
Under Article-25 Duties of employers are mentioned
in this Article.
Under Article-26 Employer shall not give work to
unregistered worker.
As per provision of
section 6(2) of Act of 1979 and under article 35(1) of scheme of
1981 registered employers have to pay an amount of levy fixed by the
Board. As mentioned in Article 35(2) at the rate of 8% of wages levy is fixed since 1-4-93. The
prescribed form is annexed at Annexure-4
(1) In making any scheme
the State Govt. may direct that a contravention of any provision
there of shall be punishable with imprisonment for a term not
exceeding three months in respect of any subsequent contravention
or with fine not exceeding five hundred rupees in respect of the
first contravention of one thousand rupees in respect of any subsequent
contravention or with both the imprisonment & fine where the
contravention is continued other conviction with a further fine
not exceeding one hundred rupees for each day on which the contravention
is so continued.
(2) Under section 18(2)
of the Act of 1979 anything contained in the of criminal Procedure-1973
(3)Save as other wise expressly
provided in this Act, any person, who contrivances any of the
provisions of this Act. Or any rule made there under shall on conviction
be punishable with fine which may extend to five hundred rupees,
& in case of continued contravention there of with an additional
fine which may extend to one hundred rupees per day for every
day during which such contravention continues Criminal action
has been taken against 925 establishment by the end of 31-12-2001
out of which 906 establishments have convicted offense in the
court of Chief Metropolitan Magistrate a sum of Rs. 85395/- as
fine is penalised that is debited in the court on the Head of
Income 19 cases are pending in the court for trial.
